Yes, the photo must have been taken after that date, i. E. Already during his service in the polish auxiliary corps. It seems doubtful that mączka could have worn a legion cavalry uniform at that time. But it cannot be ruled out (he could only pose in it for a photo). The photographed legionnaire has the insignia of a second lieutenant on his collar. There is also a visible etiquette with flat, decorative tassels placed under the left shoulder strap (loop).
